Fumant

Terms & Conditions

October 26, 2026

About these terms

These Terms & Conditions apply to every purchase from the Fumant online shop at fumant.net. The shop is run by Fumant Ltd. (“Fumant”, “we”, “us”), Gradina 19, 1700 Sofia, Bulgaria, registration no. 206275820, VAT no. BG206275820, email contact@fumant.net.

We sell premium hookahs, heat management devices (HMDs) and accessories. We do not sell tobacco or any other smoking or nicotine products.

These terms are written for consumers, that is, people buying for purposes outside their trade or business. Nothing in them limits the rights you have under mandatory consumer law. Our Shipping & Returns page summarises the practical details, and our Privacy & Cookie Policy explains how we handle your data. If you are buying as a business, please contact us.

Who can buy

By placing an order, you confirm that:

  • you are at least 18 years old;
  • you are legally able to enter into a binding contract;
  • you live in, and are ordering for delivery to, one of the countries we ship to.

We currently deliver to all EU member states, the United Kingdom, Switzerland, Norway, Serbia, the United States, Canada and Brazil. The list of countries shown at checkout is always the current and authoritative one.

We may cancel an order if we have reason to believe it was placed by someone under 18 or otherwise breaks these terms. Any payment is then refunded in full.

Rules on hookah products differ from country to country. You are responsible for making sure you can lawfully import and use our products where you live.

Products

We describe our products as accurately as we can. Photos and renders are for illustration, and colours and finishes may look slightly different on your screen.

All products are subject to availability. If an item you ordered turns out to be unavailable, we will let you know and refund what you paid for it.

Hookahs and HMDs are used with burning coals and get very hot. Always follow the product instructions, use them on a stable, heat-resistant surface, never leave them unattended while lit, and keep them away from children.

Prices and taxes

  • All prices are in euros (EUR).
  • For delivery within the EU, prices include VAT. VAT is charged at the rate of the EU country we deliver to, under the EU One-Stop-Shop (OSS) scheme where applicable. The exact amount is shown at checkout.
  • Orders delivered outside the EU are VAT-free exports. Import duties, taxes and customs fees in the destination country are not included and must be paid by you. DHL usually collects them before or on delivery.
  • Delivery charges depend on the destination and the parcel weight, and are shown at checkout before you pay.

The price that applies is the one shown at checkout when you place your order. If we find an obvious pricing error before dispatch, we will contact you. You can then confirm the order at the correct price or cancel it for a full refund.

Payment

You can pay with:

  • PayPal, including your PayPal balance and, where PayPal offers it in your country, Pay Later;
  • credit or debit card, processed securely by Braintree, a PayPal service.

Your bank may ask you to confirm a card payment with 3-D Secure. Payment is processed when you place your order. Card details are handled directly by Braintree, and we never see or store your full card number.

If we can't accept your order, or can only supply part of it, we refund the amount for the items not supplied to your original payment method.

How your contract is formed

  1. Add products to your cart and go to checkout.
  2. Enter your contact and delivery details and choose how to pay.
  3. Check your order summary. Until you place the order, you can correct any details or go back and change your cart.
  4. Place your order with the final order button. Placing an order means you are obliged to pay for it.

Straight after you order, we email you an order acknowledgement. It confirms that we have received your order but does not mean we have accepted it yet. Your order is an offer to buy from us.

The contract is concluded when we accept your order. We do this either by emailing you an Order Confirmation to say your goods have been dispatched, or by delivering the goods to you, whichever happens first.

The contract covers only the products whose dispatch we have confirmed. If an order ships in parts, we confirm each further part in a separate Order Confirmation. We do not have to supply items from your order until we have confirmed their dispatch.

We keep a record of your order, and you can ask us for a copy at any time. These terms are always available on this page, and we recommend saving or printing a copy. You can conclude the contract in any language our shop is available in.

Delivery and risk

We ship with DHL Express. Orders are dispatched on working days (Monday–Friday), typically within 1–2 working days. Orders placed at the weekend are dispatched on the next working day. See Shipping & Returns for details.

Please check your delivery address carefully. It can't be changed after you have submitted your order. If you notice a mistake, contact us straight away.

We are responsible for loss of or damage to the goods in transit until you, or someone you have chosen to receive them, take physical possession of them. At that moment the risk passes to you.

Right of withdrawal and returns

Withdrawal period

The period ends 30 days after the day on which you, or someone you have chosen (other than the carrier), take physical possession of the goods. If your order arrives in several parcels, it runs from the day you receive the last one. The first 14 days are your legal right of withdrawal. Days 15 to 30 are our voluntary extension.

How to withdraw

Before the period ends, tell us clearly that you want to withdraw. The quickest way is to start a return from your account. You can also use our support form, email contact@fumant.net, or write to Fumant Ltd., Gradina 19, 1700 Sofia, Bulgaria. You may use our model withdrawal form, but you don't have to. You meet the deadline as long as you send your notice before the period ends. We will reply with a return reference and return instructions.

Sending the goods back

Send the goods back without undue delay and no later than 14 days after telling us you are withdrawing. You pay the direct cost of returning them, unless they are faulty or we sent you the wrong item. If you use the prepaid DHL label we send you, that cost is a flat €15, which we deduct from your refund. You can use another tracked courier at your own cost instead: email us first, and send us the tracking details. If you return goods because you changed your mind, the parcel is your responsibility until it reaches us, so we recommend a tracked and insured service.

Refund

We refund the price of the returned goods without undue delay and no later than 14 days after receiving your withdrawal notice. If you withdraw from your whole order within the legal 14-day period, we also refund the original delivery charge, if you paid one. We may hold back the refund until we have received the goods or you have shown us proof that you sent them, whichever is earlier. Refunds go to your original payment method, and you pay no fees for them.

Condition of returned goods

You may handle the goods as you would in a shop to check what they are, how they look and how they work, and opening the box is fine. If they have been handled more than that, for example used with coals, or come back incomplete or damaged, we may deduct an amount for their loss in value from your refund.

For returns made under our voluntary extension (days 15 to 30), items must be unused, complete and in their original packaging, including any inner bags.

Exchanges

Instead of a refund, you can ask to exchange an item for another product or colour, subject to availability.

Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, under product liability law, or in any other case where the law does not allow liability to be limited.

Otherwise, we are not liable for losses that were not reasonably foreseeable when the contract was concluded, or for damage caused by using a product against its instructions.

Website content

All content on fumant.net, including text, photos, 3D models, logos and designs, belongs to Fumant Ltd. or its licensors. You may not copy it or use it commercially without our written permission.

Your personal data

We use your personal data to process and deliver your order and to provide customer support. Our Privacy & Cookie Policy explains the details.

Complaints and disputes

If something isn't right, please contact us first through our support form or at contact@fumant.net. Most issues can be solved quickly that way.

If we can't find a solution together, you can contact the Bulgarian Commission for Consumer Protection (KZP, kzp.bg). You can also take the dispute to one of the KZP's conciliation commissions, which resolve consumer disputes out of court. Consumers in other EU countries can get free help from the European Consumer Centre in their own country.

The EU Online Dispute Resolution (ODR) platform closed on 20 July 2025 and is no longer available. You can always take legal action in the competent courts.

Applicable law

These terms, and any contract made under them, are governed by Bulgarian law. As a consumer, you keep the protection of the mandatory laws of your country of residence and may also bring proceedings in the courts there.

Changes to these terms

We may update these terms from time to time. Your order is governed by the version published when you placed it. The date of the latest update is shown at the top of this page.
